The respondent claimed that she was the rightful heir of the recorded landholder Ayodhi Tanti and that the mutation was wrongly granted without her knowledge. However, the High Court noted that she did not receive any notice earlier, and although she filed a BLDR case and a mutation appeal, the judicial findings of the D.C.L.R. had confirmed the mutation in favor of the petitioner.

The High Court observed that the D.C.L.R., after giving a reasoned decision in his quasi-judicial capacity by dismissing the mutation appeal, could not then use his administrative capacity to nullify the same order. Such an act is impermissible under law as it defeats the principle of judicial finality.
